Notices of Marriage and Civil Partnership
The notices on this board are exhibited for the purpose of enabling persons objecting to a marriage or the formation of a civil partnership to declare it. Each notice remains on the board for 28 days and the superintendent registrar’s certificate for marriage or the civil partnership schedule cannot be issued until after that period has expired.
If this objection is against a marriage it should be brought to the attention of the superintendent registrar who will advise on the procedure for entering a caveat under section 29 of the marriage act 1949. If the objection is against the formation of a civil partnership it should be brought to the attention of the registration authority who will advise on the procedure for objecting under section 13 of the civil partnership act 2004.
Objections are usually entered where there are grounds for believing that:
  • there is a legal impediment to the marriage or the formation of the civil partnership, or
  • one of the parties does not validly consent to the marriage or the proposed civil partnership because:
  • person is incapable of understanding the nature and purport of the marriage ceremony or the formation of the civil partnership
  • a person is entering into marriage or is forming a civil partnership under duress
A person who has given consent to marriage or proposed civil partnership of a minor may withdraw that consent at any time.
